About SkyGrade

SkyGrade (skygrade.io and the @skygradeio account on X) publishes forecasts of sunrise and sunset color quality for the United States. SkyGrade is operated by James Pettus. By using the site, its graphics, or its data you agree to these terms. If you don't agree, please don't use the service.

Forecasts are estimates

SkyGrade forecasts are experimental, automated estimates built from weather model output and satellite data. They can be wrong, late, incomplete, or unavailable. Everything is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement.

Do not use SkyGrade for safety, navigation, aviation, marine, or emergency decisions, or for any decision where a wrong forecast could cause harm or financial loss. Don't rely on it for travel plans, paid photography commitments, or events. For weather hazards, use the National Weather Service.

Acceptable use

• Don't scrape or poll the site in a way that burdens it. Automated users should use the files on the Data page, which are published for that purpose.
• Don't present SkyGrade forecasts, graphics, or data as your own work.
• Don't imply that SkyGrade endorses you, your product, or your content.
• Don't interfere with the site, its servers, or other people's use of it.

License for forecasts and data

SkyGrade forecasts, forecast graphics, and downloadable data are licensed under the Creative Commons Attribution 4.0 International (CC BY 4.0) license. You may share and adapt them, including commercially, as long as you give credit as described on the Credit page and indicate any changes you made.

The license does not cover the SkyGrade name, logo, or brand, or the website's code and design. Those remain the property of SkyGrade and may not be used without permission, except to give credit as described on the Credit page.

Third-party data

SkyGrade uses publicly available data, including open map data from Natural Earth and the U.S. Census Bureau. Fonts are used under the SIL Open Font License. These sources do not endorse SkyGrade.

Limitation of liability

To the fullest extent permitted by law, SkyGrade and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or opportunity, arising from your use of or inability to use the service, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the amount you paid to use the service, which is zero.

Indemnity

You agree to hold SkyGrade and its operator harmless from claims arising from your misuse of the service or your violation of these terms.

Changes and termination

SkyGrade may change, suspend, or discontinue any part of the service at any time. We may update these terms; the effective date above will change when we do, and continued use means you accept the updated terms. We may block access for anyone who violates these terms.

Governing law

These terms are governed by applicable law of the United States. If any part of these terms is found unenforceable, the rest remains in effect.
